Title sheet (list vlastnictví, LV)
LVThe set of land registry data on the properties of one owner or co-owners within a cadastral area (Act No. 256/2013 Coll.). It lists the owners (part A), the properties (B), rights benefiting the property (B1), restrictions on ownership such as liens, easements and pre-emption rights (C), notes (D) and acquisition titles (E).
Example
Before granting a CZK 4,000,000 mortgage at 5.00 % on a flat priced at CZK 5,000,000, the bank checks the LV: the seller in part A, the unit with the correct share in B, and in C the lien of the seller's bank, which the purchase price will pay off. If it also finds an enforcement lien in C, it will not approve the loan until that lien is deleted.
In practice
A title sheet has seven parts under the cadastral decree (No. 357/2013 Coll.):
- A: the owners and their shares;
- B: the properties, with “P” in front of any property affected by a pending change (plomba);
- B1: rights that benefit these properties, such as a right of way over a neighbour's plot;
- C: rights that burden them, such as liens (zástavní právo), easements and pre-emption rights;
- D: notes, plombs and other entries, for example a note on enforcement;
- E: the documents on which the owner's entry is based;
- F: tax data for land.
You can look up any property free of charge and without registering in the ČÚZK viewer at nahlizenidokn.cuzk.gov.cz; the bank usually wants an official extract. A plomba means proceedings are pending: the office may enter a new right no earlier than 20 days after notifying the owner, and each application for registration costs CZK 2,000. Buyers sometimes skim past an easement or a pre-emption right in part C and first hear about it from the valuer.
How it differs
The LV is one sheet of the katastr nemovitostí (land registry), which is the whole public register. Nor is it the acquisition title: the purchase or gift agreement is the deed on which the entry was based, and the LV merely cites it in part E.
