Application for registration in the land registry (návrh na vklad)
A form-based filing that opens proceedings to record a right in the katastr nemovitostí (Czech land registry) under Act No. 256/2013 Coll., the Cadastral Act. The deed (purchase, pledge or gift agreement) is attached and an administrative fee of CZK 2,000 is paid per application. The moment it is delivered to the cadastral office, a plomba (pending-change flag) is created, and the effects of the entry date back to that day.
Example
Buying a flat for CZK 5,000,000 with a CZK 4,000,000 mortgage at 5.00 %: two applications are filed, one to register ownership under the purchase agreement and one to register the bank's lien (zástavní právo). Fees come to 2 × CZK 2,000, i.e. CZK 4,000. The bank usually releases the money into escrow once it receives the application bearing the filing office stamp.
In practice
An attorney or the bank usually files it, but you can also do it yourself, in person or electronically on the form provided by ČÚZK (the Czech Office for Surveying, Mapping and Cadastre). The registry examines formal requirements. A wrongly identified unit or an uncertified signature leads to suspension or rejection, which costs time and the fee. If the buyer is meant to be the pledgor, don't file the lien application ahead of the transfer of ownership.
How it differs
Filing and entry are two different things: the application starts the proceedings, while registration (vklad) is the entry the cadastral office makes after review. A plomba is the visible mark on the title sheet showing that an application has been filed and proceedings are under way. Rights entered by record (záznam), e.g. after an inheritance, need no application for registration.
