Joint marital property (SJM/BSM)

BSM (SJM)

Joint property of spouses, which by default includes any real estate acquired during the marriage. In practice, both spouses take out the mortgage together and are jointly liable to the bank. A prenuptial agreement can exclude property from SJM. After divorce, the property is settled as part of the asset division.
